1. Introduction These Terms & Conditions govern access to and use of the Hermetic Arts website, web application, and related services. By accessing, browsing, creating an account, signing in, or using any part of the platform where these Terms & Conditions apply, you agree to comply with them. If you do not agree, you must not use the platform. Hermetic Arts is a brand, web application, and platform operated by IAF Tech Development. The Hermetic Arts brand, software, visual identity, content structure, and associated intellectual property are owned by IAF Design and are used by IAF Tech Development for the operation of the Hermetic Arts platform. Hermetic Arts is not a separate incorporated entity unless expressly stated. It is presented as a platform and brand operated by IAF Tech Development. 2. About the Platform Hermetic Arts provides a platform designed to support creative visibility, profile presentation, discovery, client interaction, content participation, and related tools and services where enabled. The platform may include, depending on availability and rollout phase: public profiles practitioner discovery features messaging services bookings content participation account and profile tools payment-related tools other related platform functionality Not all features are necessarily active at all times. 2A. Platform Role and Third-Party Services or Goods Platform Role and Third-Party Services or Goods Hermetic Arts operates primarily as a curated platform and intermediary unless expressly stated otherwise in a specific transaction, listing, booking flow, checkout flow, service page, item page, or written agreement. This means that, in most cases, services offered through the platform are offered by independent Practitioners or other approved third-party providers, and goods, products, or items offered through the platform are offered by the relevant seller, creator, or provider responsible for that offer. Although Hermetic Arts may review, curate, approve, present, organise, or monitor participation standards for the platform, it does not guarantee the quality, safety, legality, authenticity, suitability, merchantability, fitness for purpose, performance, fulfilment, or outcome of services offered by Practitioners or of goods, items, or products offered by sellers or other third parties through the platform, unless Hermetic Arts is expressly identified as the direct provider, direct seller, or direct contracting party in the relevant flow or agreement. Practitioners, sellers, and other third-party providers remain responsible for what they offer through the platform, including where applicable: - the accuracy of descriptions and representations - service quality and professional conduct - item quality, condition, legality, safety, and authenticity - fulfilment, delivery, timing, and completion - pricing accuracy - compliance with applicable law - handling of complaints, disputes, cancellations, returns, refunds, or service issues to the extent applicable under the live platform structure and governing terms Users are responsible for reviewing relevant descriptions, communications, transaction information, and provider details carefully before proceeding with any service, booking, purchase, or engagement with a third party through the platform. 2B. Spiritual and Esoteric Services Tarot readings, astrology, alchemy, divination, intuitive guidance, energetic practices and other spiritual or esoteric services are subjective and interpretive in nature. Accuracy, predictions, interpretations, outcomes, satisfaction, and freedom from confusion, disagreement or misunderstanding are not guaranteed. Readings and related practitioner communications are provided for spiritual, educational, cultural, creative or personal-reflection purposes. They are not substitutes for medical, mental-health, legal, financial, tax, veterinary, emergency or other regulated professional advice. Users remain responsible for significant decisions and should consult an appropriately qualified professional where needed. Practitioners remain responsible for describing services honestly, avoiding guaranteed predictions or outcomes, complying with law and platform policies, and providing services with reasonable care and skill. This section should be read together with the Spiritual Services, Readings, Listings and Platform Responsibility Disclaimer at /legal/platform-role-services-and-items-disclaimer. Nothing in this section removes statutory consumer rights, complaint and remedy rights, or liability that cannot lawfully be excluded. 2C. Astrology Compatibility Reports Astrology compatibility reports are symbolic and interpretive. Scores are internal symbolic comparison measures, not scientific measurements, factual predictions, or probabilities of relationship success, longevity, safety, suitability, or compatibility. Compatibility reports may describe supportive, challenging, mixed, or complex factors. Supportive factors do not guarantee positive outcomes. Challenging factors do not prove incompatibility, harm, or failure. Mixed factors represent complexity, interaction, or areas that may require attention. A report must not be presented as factual evidence about another person, their intentions, their character, their health, or the future of any relationship or interaction. Birth-time uncertainty can reduce the reliability of houses, angles, directional house overlays, and related interpretation. Planetary-only or reduced-confidence reports have explicitly limited scope. A missing factor means unavailable data, not a negative judgement. Compatibility reports are not medical, mental-health, legal, financial, safeguarding, professional, or relationship advice. They should not be used as the sole basis for major personal, medical, legal, financial, safeguarding, relationship, housing, employment, family, immigration, or safety decisions. Users remain responsible for their own decisions, communication, consent, boundaries, and interactions, and should seek appropriately qualified professional advice where needed. The wording in this section should be reviewed by an appropriately qualified solicitor before public commercial launch. 2D. One-Off Astrology Comparison Purchases Where enabled, a one-off astrology comparison purchase grants permanent access to one exact saved chart comparison under the versioned calculation and report identity used at purchase. Chart A plus Chart B and Chart B plus Chart A are treated as the same owned comparison for purchase purposes. The purchase does not grant permanent access to every future chart pair, unlimited compatibility reports, or every recalculation. A materially different source chart snapshot, report schema, scoring policy, interpretation policy, or future version may be treated as a different product where the versioned identity requires it. Permanent ownership remains available without an active membership unless access is lawfully revoked, fully refunded, reversed, disputed, or otherwise changed under the applicable policy and law. A successful payment redirect alone does not grant access; access is granted only after server-side payment reconciliation. The price is shown through secure Checkout, and no fixed price in these Terms should be treated as overriding the secure Checkout amount. Purchase history and related commercial audit records may be retained for payment processing, reconciliation, disputes, refunds, fraud prevention, accounting, tax, compliance, legal obligations, and platform integrity even if the saved comparison record is later deleted. 2E. Membership Astrology Comparison Allowance Where enabled, qualifying monthly memberships include five new full astrology comparison unlocks per subscription billing period. The allowance follows the actual subscription billing period, not a calendar month. An explicit successful membership-unlock action consumes one allowance for a new exact saved comparison. Opening the page, checking access, or reopening an already membership-unlocked comparison does not consume another allowance. Reversing the same chart pair does not create a separate unlock. Permanent purchases do not consume membership allowance. Membership unlocks are not permanent ownership. Existing membership unlocks remain recorded when membership ends, but membership-only full access requires a currently qualifying membership. A later qualifying membership may restore access to an existing membership unlock without consuming another allowance. Used allowances do not normally roll over unless a future policy explicitly says otherwise, and cancellation at period end does not promise another allowance after the subscription actually ends. Allowance rules may change prospectively with appropriate notice, without rewriting historical allowance records. 2F. Astrology Comparison Refunds and Access Changes Refund eligibility for digital astrology comparison purchases may depend on the circumstances, applicable law, and whether digital access has begun. Nothing in these Terms removes applicable statutory rights or states that digital purchases can never be refunded. In the current v1 implementation, a partial refund may mark the purchase as partially refunded while permanent access remains active unless applicable law or a separately communicated resolution requires a different outcome. A full refund may remove access to the refunded comparison when the refunded purchase is still the current granting purchase. A refund of an older purchase should not remove access granted by a later valid purchase. Fraudulent payments, payment disputes, chargebacks, administrative reversals, legal requirements, or confirmed platform misuse may affect access and payment records. Final consumer-law wording should be reviewed by an appropriately qualified solicitor before public commercial launch. 3. Eligibility and Accounts You may use the platform only if you are legally able to do so and only in accordance with these Terms & Conditions. Where account registration is available, you agree that: the information you provide must be accurate and not misleading you will keep your account details up to date where appropriate you will keep your login credentials secure you are responsible for activity carried out through your account unless caused by our failure or another matter outside your responsibility you must not impersonate another person or create an account using false identity details We may refuse registration, restrict access, or require additional verification where reasonably necessary for platform integrity, safety, compliance, or operational reasons. 3A. Identity, Account Accuracy, and Misrepresentation You agree that all information you provide to Hermetic Arts, including your name, contact details, profile information, professional details, credentials, payment information, and any identity or verification information, must be accurate, current, complete, and not misleading. You must not create an account, submit an application, request a booking, publish a profile, offer services, send messages, make purchases, or interact with the platform using a false identity, a misleading identity, another person's identity, unauthorised documents, false credentials, or information that is intended to deceive Hermetic Arts, practitioners, clients, administrators, payment providers, or third-party service providers. You must not impersonate any person or organisation, falsely claim approval, verification, qualifications, professional status, affiliation, authorship, ownership, or authority, or use Hermetic Arts to misrepresent who you are or what you are authorised to offer. Hermetic Arts may request reasonable additional information or verification where necessary to protect users, prevent fraud, confirm eligibility, investigate suspected misuse, comply with legal obligations, or maintain platform trust and safety. Any verification request will be handled in accordance with our Privacy Policy and applicable data protection requirements. If we reasonably believe that an account, application, profile, booking, listing, message, payment, document, credential, or submission involves false identity, impersonation, fraudulent information, misleading credentials, unauthorised use of another person's details, or other material misrepresentation, we may take action including refusing, suspending, restricting, removing, reversing, delaying, or cancelling the relevant account, application, profile, service, booking, listing, order, payment, payout, or submission. We may also preserve relevant records, request clarification, require re-verification, notify affected users where appropriate, report suspected fraud or unlawful conduct to relevant authorities or service providers where legally permitted or required, and cooperate with lawful investigations. You are responsible for any loss, claim, complaint, chargeback, dispute, investigation, cost, damage, or liability arising from false, misleading, unauthorised, or fraudulent information you provide or use on the platform. 3B. Integrity, Non-Harm, and Good Faith Conduct By using Hermetic Arts, you agree to act honestly, lawfully, and in good faith toward the platform, its members, practitioners, clients, administrators, and wider community. You must not threaten, plan, encourage, organise, assist, or participate in harm, intimidation, harassment, coercion, deception, exploitation, sabotage, or unlawful conduct against Hermetic Arts, its members, users, practitioners, clients, administrators, partners, or associated community. You confirm that you are not bound by, acting under, or relying on any private agreement, instruction, obligation, arrangement, or outside influence that requires or encourages you to act against the lawful interests, safety, trust, integrity, or wellbeing of Hermetic Arts or its members. You must not knowingly conceal, support, assist, or participate in fraudulent, abusive, unlawful, coercive, or harmful conduct involving the platform or its members. Where you become aware of a serious risk, unlawful activity, fraud, abuse, harassment, coercion, or organised misconduct affecting Hermetic Arts or any member of the platform, you agree to report it through the appropriate support, moderation, or legal channels where it is safe and lawful to do so. You must not knowingly lie, submit false information, encourage dishonesty, bribe, attempt to bribe, pressure, manipulate, threaten, mislead, or induce any member, user, practitioner, client, administrator, partner, or service provider to act dishonestly, unlawfully, or against the integrity of the platform. You agree to provide your services, listings, communications, applications, submissions, and platform activity with reasonable care, honesty, professionalism, and commitment, and to make genuine offers only where you are willing and able to provide the service, product, content, or support described. Hermetic Arts may investigate, restrict, suspend, remove, reject, cancel, withhold approval, block access, preserve relevant records, or take other appropriate action where we reasonably believe that a user has breached this clause or presents a risk to platform safety, trust, integrity, legal compliance, or community wellbeing. 4. Permitted Use You may use the platform only for lawful purposes and only in a way that is consistent with these Terms & Conditions and any related policies. Permitted use may include: browsing public pages viewing approved public practitioner profiles creating and using an account where available using approved features made available to your role or account type communicating through permitted platform tools interacting with practitioners, services, or content where relevant and enabled 5. Prohibited Use You must not: use the platform for any unlawful, fraudulent, abusive, or harmful purpose attempt to gain unauthorised access to any account, admin area, system, database, or restricted feature scrape, harvest, extract, or collect data from the platform through automated or unauthorised means copy, mirror, frame, clone, reproduce, or reverse engineer the platform, its layout, workflows, systems, or protected content except where expressly permitted by law upload, transmit, or distribute malware, malicious code, or anything designed to disrupt, damage, or impair the platform use the platform to harass, threaten, abuse, deceive, or impersonate others misuse messaging, booking, payment, or communication features infringe any copyright, trade mark, privacy, confidentiality, or other rights of any person or entity use the platform in any way that could damage the reputation, security, integrity, or operation of Hermetic Arts 6. Intellectual Property The platform, including its software, design, layout, branding, trade marks, logos, workflows, databases, written content, graphics, and non-user materials, is protected by applicable intellectual property laws. The Hermetic Arts brand, software, visual identity, content structure, and associated intellectual property are owned by IAF Design and are used by IAF Tech Development for the operation of the Hermetic Arts platform. Nothing in these Terms & Conditions transfers ownership of any intellectual property rights to you. You are granted only a limited, revocable, non-exclusive, non-transferable right to access and use the platform for its intended purpose and in accordance with these Terms & Conditions. 7. User Content Where you submit, upload, send, or otherwise make content available through the platform, you remain responsible for that content. You confirm that: you have the right to submit or use the content in that way the content is accurate to the best of your knowledge where factual statements are made the content does not infringe the rights of others the content is not unlawful, misleading, abusive, defamatory, or otherwise inappropriate for the platform You grant Hermetic Arts and its operating entity a limited right to host, store, process, display, format, and use such content as reasonably necessary to operate, maintain, secure, review, moderate, and promote the platform and its services, subject to applicable law and any more specific terms that may apply to certain user roles. 8. Platform Changes and Availability We may update, modify, suspend, restrict, or discontinue any part of the platform at any time, including features, tools, content structures, account permissions, or access methods. We do not guarantee that the platform, or any part of it, will always be available, uninterrupted, secure, error-free, or suitable for every intended use. Some features described on the platform may be planned, limited, conditional, region-specific, role-specific, or phased. 9. Privacy and Cookies Your use of the platform is also subject to our: Privacy Notice Cookie Notice Acceptable Use Policy These documents form part of the wider legal and policy framework applicable to use of the platform. 10. Suspension, Restriction, and Termination We may suspend, restrict, remove, or terminate access to the platform, an account, content, or specific features where reasonably necessary, including where: these Terms & Conditions or related policies are breached there is suspected fraud, abuse, security risk, or unlawful conduct a complaint, investigation, or rights issue requires intervention we are required to do so for legal, operational, or compliance reasons the integrity, safety, or reputation of the platform may otherwise be at risk We may also remove or restrict content where reasonably necessary for moderation, legal compliance, intellectual property reasons, safety, or platform standards. 11. No Guarantee of Outcomes Hermetic Arts provides a curated platform environment, but does not guarantee: a certain level of visibility bookings, sales, or income successful contact between users uninterrupted service access a specific ranking, placement, or discovery outcome the ongoing availability of any specific feature the accuracy or fulfilment of subjective spiritual predictions or interpretations that every reading or service will be understood without confusion, disagreement or misunderstanding any particular personal, professional, financial, spiritual or other result For the avoidance of doubt, Hermetic Arts does not guarantee the quality, suitability, safety, legality, condition, performance, or outcome of third-party services or third-party goods/items offered through the platform unless it is expressly stated to be the direct provider or direct seller in the relevant transaction. 12. Disclaimers To the extent permitted by law, the platform is provided on an "as available" and "as offered" basis. Readings, practitioner messages, listings, articles and other Platform content are not substitutes for qualified professional advice. Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so. Any more detailed exclusions, limitations, consumer law wording, and spiritual-services wording should be read subject to applicable law and with the Spiritual Services, Readings, Listings and Platform Responsibility Disclaimer at /legal/platform-role-services-and-items-disclaimer. 13. Liability Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate wrongdoing, failure to provide services with reasonable care and skill, breach of statutory consumer rights, or any other liability that cannot legally be excluded or restricted. Subject to the above, and to the extent permitted by law, Hermetic Arts and its relevant operating or rights-holding entities shall not be liable for indirect or consequential loss, loss of opportunity, loss arising solely from subjective interpretation, unfulfilled prediction, confusion or disagreement where no breach of duty has occurred, or loss arising from matters outside reasonable control. Nothing in these Terms prevents a user from reporting a practitioner, seller, service or listing, making a complaint, requesting an appropriate remedy, disputing a transaction, exercising applicable cancellation, refund, repair, replacement or repeat-performance rights, obtaining independent legal advice, or exercising any statutory consumer right. 14. Changes to These Terms We may update these Terms & Conditions from time to time. Where changes are material, we may take additional steps to bring them to users' attention, including notices inside the platform, updated acceptance flows, or other appropriate communication methods. Continued use of the platform after an update may constitute acceptance of the updated Terms & Conditions where permitted by law and where appropriate notice has been given. 15. Governing Law These Terms & Conditions are intended to be interpreted in accordance with applicable law, including any mandatory laws that apply to the user, the platform, or the relevant transaction or interaction. 16.
