Spiritual Services, Readings, Listings and Platform Responsibility Disclaimer

1. Platform role Hermetic Arts is a brand, web application and online platform operated by IAF Tech Development. The Hermetic Arts brand and associated intellectual property are owned by IAF Design. Hermetic Arts enables independent practitioners and sellers to publish profiles, offer spiritual or creative services, provide readings, communicate with clients, and advertise products, digital content and other listings. Unless expressly stated otherwise in the relevant service, listing, checkout or written agreement, practitioners and sellers are independent providers. They are not employees, partners, representatives or agents of Hermetic Arts, IAF Tech Development or IAF Design merely because they use the Platform. Each practitioner and seller remains responsible for their own statements, representations, services, readings, products, listings, fulfilment and conduct. 2. Nature of readings and spiritual services Tarot readings, astrology, alchemy, divination, intuitive guidance, energetic practices and other spiritual or esoteric services are interpretive and subjective in nature. They are offered for spiritual, educational, cultural, creative or personal-reflection purposes. No practitioner, seller or Platform Party guarantees: - the accuracy or completeness of a reading - that a prediction, impression or interpretation will occur or prove correct - that every statement will be understood in the same way - the absence of confusion, uncertainty, disagreement or misunderstanding - any particular personal, professional, financial, spiritual or other result - that a user will be satisfied with every interpretation - that a service will produce a promised transformation or outcome A difference of interpretation, an incorrect or unfulfilled prediction, confusion during or after a reading, disagreement with a practitioner, dissatisfaction with a subjective interpretation, or failure to obtain an expected result does not by itself establish wrongdoing or liability by Hermetic Arts, IAF Tech Development or IAF Design. This does not excuse fraud, deliberate wrongdoing, misleading commercial conduct, negligence, failure to use reasonable care and skill, or breach of applicable law. 3. No professional advice Readings, practitioner messages, listings, articles and other Platform content are not substitutes for qualified: - medical advice - mental-health or psychological care - legal advice - financial, investment or tax advice - veterinary advice - emergency assistance - other regulated professional services Users should consult an appropriately qualified professional before making significant decisions. Users must not delay obtaining professional or emergency assistance because of a reading, prediction, practitioner statement, listing or other Platform content. 4. User responsibility Users remain responsible for their own decisions, actions and interpretation of information received through Hermetic Arts. Users should not make significant medical, legal, financial, employment, relationship, safety or business decisions solely on the basis of: - a reading - a prediction - an intuitive impression - a practitioner statement - a product claim - a Platform listing Nothing in this notice prevents a user from relying reasonably on clear contractual promises, statutory rights, accurate product descriptions or services that the law requires to be performed with reasonable care and skill. 5. Practitioner responsibility Practitioners remain responsible for describing their identity, experience and services honestly; avoiding false or misleading claims; clearly explaining the subjective nature and limitations of readings; avoiding guaranteed predictions or guaranteed outcomes; providing services with reasonable care and skill; complying with the Prohibited Practices policy; not presenting spiritual services as regulated professional advice; protecting client confidentiality and personal information; complying with applicable consumer, advertising and other laws; and responding appropriately to complaints and service problems. Platform approval, profile approval, a badge, verification or curation does not transfer responsibility for a practitioner's service to the Platform. 6. Seller and listing responsibility Sellers remain responsible for ensuring that listings are accurate and not misleading, products are lawful and safe to sell, product descriptions match what is supplied, material limitations and safety warnings are disclosed, prices, delivery information and availability are accurate, goods are of satisfactory quality and fit for any purpose made known where applicable, fulfilment, delivery, returns and refunds comply with applicable law, and intellectual-property rights are respected. Hermetic Arts and the other Platform Parties do not automatically endorse or adopt every claim, description, image, qualification, product, service or representation supplied by an independent practitioner or seller. Nothing in this section removes a consumer's rights concerning faulty, unsafe, misdescribed, undelivered or otherwise non-compliant goods or services. 7. Verification and approval A verification badge, approval status, curated profile, identity check, certification label or other Platform indicator confirms only the particular checks expressly described by Hermetic Arts. It is not a guarantee of the accuracy of every reading, future practitioner conduct, service quality in every case, the accuracy of every seller claim, product safety or suitability, a specific result, or a particular commercial or personal outcome. 8. Platform Parties For this notice, Platform Parties means Hermetic Arts in its capacity as the Platform and brand, IAF Tech Development, IAF Design, and their respective owners, directors, officers, employees, contractors, service providers, affiliates and agents when acting in connection with operation of the Platform. Independent practitioners and sellers are not included as Platform Parties merely because they use Hermetic Arts. This definition does not imply that unrelated third parties, Stripe, hosting providers, independent practitioners or sellers become IAF employees or agents. 9. Limitation of Platform responsibility To the fullest extent permitted by applicable law, the Platform Parties will not be responsible for loss or damage arising solely from the subjective interpretation of a reading; an inaccurate or unfulfilled prediction; disagreement with a practitioner's interpretation; confusion or misunderstanding during or after a reading; reliance contrary to the warnings clearly provided in this notice; expectations or results that were never expressly guaranteed; statements or conduct of an independent practitioner or seller that the relevant Platform Party did not authorise, adopt or cause; seller-supplied listing descriptions or representations that the Platform Party did not know were unlawful or misleading; third-party products, services, websites or communications; losses that were not reasonably foreseeable when the relevant contract was made; losses that were not caused by a breach of duty by the relevant Platform Party; or matters outside the reasonable control of the relevant Platform Party. Displaying, moderating, processing payment for or receiving a fee from a listing does not automatically remove every possible Platform duty. 10. Matters not excluded Nothing in this notice excludes or restricts liability for death or personal injury caused by negligence; fraud or fraudulent misrepresentation; failure to provide a service with reasonable care and skill; breach of statutory consumer rights; deliberate wrongdoing; misleading statements that form part of the relevant consumer contract; or any other liability that cannot legally be excluded or restricted. Nothing in this notice prevents a user from reporting a practitioner, seller, service or listing; making a complaint; requesting an appropriate remedy; disputing a transaction; exercising cancellation, refund, repair, replacement or repeat-performance rights where applicable; obtaining independent legal advice; or exercising any statutory consumer right. 11. Acceptance and interpretation By booking a reading, purchasing a service or item, communicating with a practitioner, or otherwise using relevant Hermetic Arts features, the user acknowledges the subjective nature of spiritual services and agrees to apply their own judgement. Acceptance of this notice does not waive any right that cannot lawfully be waived. Where this notice conflicts with mandatory law, mandatory law prevails.
